The purpose of this paper is to make the beyond a reasonable doubt standard in criminal trials more comprehensible for the modern juror while also increasing the modern juror’s motivation and ability to apply this standard consistent with trial proceedings. The major problems addressed include why the beyond a reasonable doubt standard is so difficult for modern jurors to understand in addition to why modern jurors lack both the motivation and ability to perform their integral function in criminal trials due to their enforced passive role. This paper traces the origins of the modern jury, delving into the centuries-long transition of the jury from an active to passive function, and the impacts historical change has had on the modern juror’s role in criminal trials. It also looks to define the beyond a reasonable doubt standard in terms of case law and pattern jury instructions and through contrast with its constituent lower civil standards of evidentiary certainty. The solution posed to remedy the aforementioned issues rests on a unique application of metaphor and imagery that can be implemented in lawyers’ rhetorical methods to instruct jurors on their paramount function in modern criminal suits.

This seems to be a problem that should be concerning in this modern age. We would be hard pressed to observe doctors in the U.S. currently performing medical procedures as they would have in 1960 considering the technological advancements that have taken place in society since then. Many of the processes in the legal system are extremely static and even archaic. It seems to be an opportune time to revolutionize the whole system as advancements continue; but, this revolution must take into account both the positive and negative repercussions that are possible moving forward.

My thesis offers original research is in its direct analysis of the IRS conflict of interest regulations and their applicability to STOs, its discussion of my experience setting up an STO, and my interviews of State Legislators as a primary source. The primary goals of my investigation are to 1. Determine the regulations and standards that exist to prevent conflicts of interest in the operation of Arizona STOs. 2. Examine instances of alleged conflicts of interest encountered by STO operators. 3. Discuss the ethical implications of STO operator actions in situations of conflicts of interest. And 4. Propose legislative solutions to remove any and all conflicts of interest. From my examination of financial records and from my interviews with other state legislators, I have concluded that Arizona Christina School Tuition Organization is violating IRS regulations by operating with an objective of conferring on its director a private benefit. The STO I helped form, ------------- STO will need to carefully document its expenses and contracts to justify its overhead margin or else risk running afoul of the same IRS regulations. Even if an STO like ------------- STO, is allowed by Arizona law to have an overhead margin of 10%, those expenses must be justified, particularly if they confer a private benefit to restricted persons. Ultimately, even if an STO deliberately flouts IRS regulations regarding private benefits realized by "disqualified" persons, it is highly unlikely that the STO will face IRS scrutiny. Therefore, there exist sufficient federal regulatory safeguards to prevent financial conflicts of interest among Arizona STO board members, but such regulations are not sufficiently enforced to prevent those conflicts of interest.

This critical analysis uses the Collective Bargaining Agreement to explore the NBA operational structure, examine the current state of affairs, and propose solutions to fundamental issues. Included is an in-depth investigation into correcting team financial reporting and fixing market inequality across the league. Most notably, a proposal to restructure the current revenue sharing system is presented. By progressing the system to correlate winning with team financial performance, there is potential to improve competition and alleviate existing conflict. This will produce a better overall product for the NBA that drives more consumer interest, yields more revenue, and supports stronger international growth opportunity.

This paper discusses the levels of job satisfaction amongst practicing lawyers, with a distinction between government-employed lawyers (public) and those in the private sector. The purpose of this report is to provide insight into the joys and sorrows of practicing law and provide those who are curious about becoming a lawyer with the tools to be the happiest lawyer that they can be throughout their career. The paper includes analysis of a primary research survey, comparisons with existing research, and a brief overview of happiness based research. It concludes with personal applications of the knowledge gained. Findings of the project conclude that publicly employed lawyers are, on average, slightly happier than lawyers in the private sector. On a scale from 1-7 public lawyers held an average happiness rating of 6.8, while private lawyers came in at a 6.06. Both factions were found to be satisfied in their work, which can dispel the myth that lawyers in general are unhappy with their job or field. Research into happiness shows that only 40% of an individual's overall happiness can be directly affected by their mindset and actins. The other 60% is comprised of genetic and circumstantial factors. Steps and advice to increase happiness derived from a profession or life are offered. The key to finding satisfaction in the workplace lies in aligning one's strengths with one's values. This paper concludes by imploring those who seek a job in the legal field to spend time understanding what their values are, and pursuing satisfaction in the workplace instead of prestige or pay.

Anytime a new product is brought to market or a new business is established, there are several legal and regulatory matters that must be addressed in order to achieve sustainable success. There are certain legal implications that every new business needs to consider, such as business structure, obtaining intellectual property, necessary licenses, agreements, liability, etc. In addition, there are also some regulations and laws that apply to only certain types of businesses. For products created for individuals with disabilities, some of these regulations include the Americans with Disabilities Act (ADA), the Web Content Accessibility Guidelines (WCAG), the Telecommunications Act of 1996, and the Individuals with Disabilities Act (IDEA). In this thesis, I study the disability product market, and the major legal and regulatory obstacles that a company might face in creating and marketing a product for consumers with either a mobile or visual disability. The research I conducted was based on a year-long project I completed in an interdisciplinary program called InnovationSpace. This paper introduces the program and our product, including a summary of the business model we created. Then, I discuss the findings of my research, before developing a plan for complying with the laws when taking our product, Naavi, to market. The major strategy discussed includes getting our product involved in public school districts through the IDEA, to give visually disabled students access to our product by making it a required component of their Individualized Education Plans (IEPs). Being able to do so would give our company an enormous business-to-business customer, which would be great for our company while simultaneously offering these students an opportunity to learn a valuable skill that can improve their daily lives.

This research was aimed at identifying the problems of the kidney transplant market and then proposing business-minded solutions. The methodology that was used to compile research was an industry analysis, a business model canvas, the lean startup methodology, academic papers, popular culture references, previous and present marketing campaigns, an internship at a local hospital, and organ transplant databases. The problems I identified was that kidney transplant industry was favorable but had few competitors, a mounting demand with a lack of supply, a lack of public awareness, negative public perception, and incorrectly focused marketing campaigns. The solutions that I constructed were the endorsement of grocery retail clinics as a step to prevent a future increase in demand for kidneys, a hybridized opt-in system that would increase the supply of transplantable kidneys, a public awareness campaign that would increase the public's awareness and shift it into a positive light, and a refocused marketing campaign that centered on why people become donors. The implementation of these solutions should be solution1, then solution 3 and 4, and then after the public has enough time to ruminate, employ solution 2.

The main objective of the research was to gather as much information and arguments about why we need to end the war on drugs and put them into one piece of work that was compelling and thorough, but also concise. This goal was achieved through first explaining how addiction is strongly related to the environment around the addict and whether they have adequate tools to bond with those around them. After coming to the conclusion that the war on drugs has been a failure and is misunderstood by most people, the strategy for legalization of recreational drugs was outlined as well as the economic, social, and health benefits of pursuing that strategy. The conclusion is that while the war on drugs has good intentions, it has been largely ineffective and imposed cruel punishments on addicts that end up causing more harm than they prevent, it is time to move forward and legalize all recreational drug use with licensed sales, harm reduction programs, and proper education to create a more effective strategy of preventing drug use and the harm it brings.
