Description
On December 27, 2008, Israel began a military campaign codenamed Operation Cast Lead with an aerial bombardment of the Gaza Strip. On January 3, 2009, Israel expanded its aerial assault with a ground invasion. Military operations continued until January 18, 2009, when Israel implemented a unilateral cease fire and withdrew its forces. When the hostilities had ended, between 1,166 and 1,440 Palestinians had been killed as a result of Israeli attacks, two-thirds of whom are estimated to be civilians. Ensuing allegations of international human rights (IHR) and international humanitarian law (IHL) violations were widespread. Amidst these claims, the United Nations Human Rights Council (UNHRC) commissioned a fact-finding team, headed by South African jurist Richard Goldstone, to investigate whether the laws of war were infringed upon. Their findings, published in a document known colloquially as the Goldstone Report, allege a number of breaches of the laws of occupation, yet give a cursory treatment to the preliminary question of the applicability of this legal regime. This paper seeks to more comprehensively assess whether Gaza could be considered occupied territory for the purposes of international humanitarian law during Operation Cast Lead. In doing so, this paper focuses on exactly what triggers and terminates the laws of occupation`s application, rather than the rights and duties derived from the laws of occupation. This paper proceeds with a brief discussion of the history of the Gaza occupation, including Israel`s unilateral evacuation of ground troops and settlements from within Gaza in 2005, a historic event that sparked renewed debate over Israel`s status as an Occupying Power vis-à-vis Gaza. The following section traces the development of the laws of occupation in instruments of IHL. The next section considers the relevant international case law on occupation. The following section synthesizes the various criteria from the IHL treaty and case law for determining the existence of a situation of occupation, and considers their application to the Gaza Strip during Operation Cast Lead. The concluding section argues that Israel maintained the status of Occupying Power during Operation Cast Lead, and discusses the legal implications of such a determination.

In this dissertation, I focus on a subset of Native American theatre, one that concentrates on peoples of mixed heritages and the place(s) between worlds that they inhabit. As it is an emergent field of research, one goal of this project is to illuminate its range and depth through an examination of three specific points of focus - plays by Elvira and Hortencia Colorado (Chichimec Otomí/México/US), who create theatre together; Diane Glancy (Cherokee/US); and Marie Clements (Métis/Canada). These plays explore some of the possibilities of (hi)story, culture, and language within the theatrical realm across Turtle Island (North America). I believe the playwrights' positionalities in the liminal space between Native and non-Native realms afford these playwrights a unique ability to facilitate cross-cultural dialogues through recentering Native stories and methodologies. I examine the theatrical works of this select group of mixed heritage playwrights, while focusing on how they open up dialogue(s) between cultures, the larger cultural discourses with which they engage, and their innovations in creating these dialogues. While each playwright features specific mixed heritage characters in certain plays, the focus is generally on the subject matter - themes central to current Native and mixed heritage daily realities. I concentrate on where they engage in cross-cultural discourses and innovations; while there are some common themes across the dissertation, the specific points of analysis are exclusive to each chapter. I employ an interdisciplinary approach, which includes theories from theatre and performance studies, indigenous knowledge systems, comparative literary studies, rhetoric, and cultural studies.

Rotorcraft operation in austere environments can result in difficult operating conditions, particularly in the vicinity of sandy areas. The uplift of sediment by rotorcraft downwash, a phenomenon known as brownout, hinders pilot visual cues and may result in a potentially dangerous situation. Brownout is a complex multiphase flow problem that is not unique and depends on both the characteristics of the rotorcraft and the sediment. The lack of fundamental understanding constrains models and limits development of technologies that could mitigate the adverse effects of brownout. This provides the over-arching motivation of the current work focusing on models of particle-laden sediment beds. The particular focus of the current investigations is numerical modeling of near-surface fluid-particle interactions in turbulent boundary layers with and without coherent vortices superimposed on the background flow, that model rotorcraft downwash. The simulations are performed with two groups of particles having different densities both of which display strong vortex-particle interaction close to the source location. The simulations include cases with inter-particle collisions and gravitational settling. Particle effects on the fluid are ignored. The numerical simulations are performed using an Euler- Lagrange method in which a fractional-step approach is used for the fluid and with the particulate phase advanced using Discrete Particle Simulation. The objectives are to gain insight into the fluid-particle dynamics that influence transport near the bed by analyzing the competing effects of the vortices, inter-particle collisions, and gravity. Following the introduction of coherent vortices into the domain, the structures convect downstream, dissipate, and then recover to an equilibrium state with the boundary layer. The particle phase displays an analogous return to an equilibrium state as the vortices dissipate and the boundary layer recovers, though this recovery is slower than for the fluid and is sensitive to the particle response time. The effects of inter-particle collisions are relatively strong and apparent throughout the flow, being most effective in the boundary layer. Gravitational settling increases the particle concentration near the wall and consequently increase inter-particle collisions.

This research is a reversal of the traditional concept of the student-teaching research experiment. Instead of studying the clear and stated goal of an apprenticeship, that of a pupil learning from the tutelage of a master, the focus here is on what a mentor-teacher learns from a student-teacher. During the act of teaching a novice, what can a mentor-teacher learn about her own practice, while demonstrating it to a pre-service teacher? Using the conceptual framework of the National Board for Professional Teaching Standards' Architecture of Accomplished Teaching, and using it within a framework centered around cognitive coaching and reciprocal mentoring, this action research study implemented an intervention that called for series of five cognitive coaching cycles between a mentor- and student-teacher designed to foster dialogue and reflection between them. The ultimate aim of this case study was to help determine what a mentor-teacher learned about her own practice as a result of mentoring a student-teacher. Qualitative data were collected over sixteen weeks in a charter high school. Five findings were identified created after the data were analyzed using a grounded theory approach, and four conclusions were drawn about the intervention's role in the mentor-teacher's reciprocal learning.

K-Nearest-Neighbors (KNN) search is a fundamental problem in many application domains such as database and data mining, information retrieval, machine learning, pattern recognition and plagiarism detection. Locality sensitive hash (LSH) is so far the most practical approximate KNN search algorithm for high dimensional data. Algorithms such as Multi-Probe LSH and LSH-Forest improve upon the basic LSH algorithm by varying hash bucket size dynamically at query time, so these two algorithms can answer different KNN queries adaptively. However, these two algorithms need a data access post-processing step after candidates' collection in order to get the final answer to the KNN query. In this thesis, Multi-Probe LSH with data access post-processing (Multi-Probe LSH with DAPP) algorithm and LSH-Forest with data access post-processing (LSH-Forest with DAPP) algorithm are improved by replacing the costly data access post-processing (DAPP) step with a much faster histogram-based post-processing (HBPP). Two HBPP algorithms: LSH-Forest with HBPP and Multi- Probe LSH with HBPP are presented in this thesis, both of them achieve the three goals for KNN search in large scale high dimensional data set: high search quality, high time efficiency, high space efficiency. None of the previous KNN algorithms can achieve all three goals. More specifically, it is shown that HBPP algorithms can always achieve high search quality (as good as LSH-Forest with DAPP and Multi-Probe LSH with DAPP) with much less time cost (one to several orders of magnitude speedup) and same memory usage. It is also shown that with almost same time cost and memory usage, HBPP algorithms can always achieve better search quality than LSH-Forest with random pick (LSH-Forest with RP) and Multi-Probe LSH with random pick (Multi-Probe LSH with RP). Moreover, to achieve a very high search quality, Multi-Probe with HBPP is always a better choice than LSH-Forest with HBPP, regardless of the distribution, size and dimension number of the data set.

The challenging search for clean, reliable and environmentally friendly energy sources has fueled increased research in thermoelectric materials, which are capable of recovering waste heat. Among the state-of-the-art thermoelectric materials β-Zn4Sb3 is outstanding because of its ultra-low glass-like thermal conductivity. Attempts to explore ternary phases in the Zn-Sb-In system resulted in the discovery of the new intermetallic compounds, stable Zn5Sb4In2-δ (δ=0.15) and metastable Zn9Sb6In2. Millimeter-sized crystals were grown from molten metal fluxes, where indium metal was employed as a reactive flux medium.Zn5Sb4In2-δ and Zn9Sb6In2 crystallize in new structure types featuring complex framework and the presence of structural disorder (defects and split atomic positions). The structure and phase relations between ternary Zn5Sb4In2-δ, Zn9Sb6In2 and binary Zn4Sb3 are discussed. To establish and understand structure-property relationships, thermoelectric properties measurements were carried out. The measurements suggested that Zn5Sb4In2-δ and Zn9Sb6In2 are narrow band gap semiconductors, similar to β-Zn4Sb3. Also, the peculiar low thermal conductivity of Zn4Sb3 (1 W/mK) is preserved. In the investigated temperature range 10 to 350 K Zn5Sb4In2-δ displays higher thermoelectric figure of merits than Zn4Sb3, indicating a potential significance in thermoelectric applications. Finally, the glass-like thermal conductivities of binary and ternary antimonides with complex structures are compared and the mechanism behind their low thermal conductivities is briefly discussed.

This study examines the possibility of using social and historical contexts, image analysis, and personal themes to engage adolescent photography students in the craft of photography. This new curriculum was designed around large themes that correspond to the developmental stage of adolescence. Issues such as self-identity, teenage stereotypes, school, family, and community were explored through examining historical documents and photographs, comparing popular culture perspectives, and learning basic semiotics. The students then worked within these ideas by creating their own photographs and reflecting upon their art making choices. The new approach was implemented in an analog film class in which basic 35mm camera and film techniques are taught. It is argued that meaning making motivates the adolescent photographer rather than the achievement of strong technical skills. This qualitative study was conducted using an action research approach, in which the author was both the classroom teacher and the researcher. The study incorporates data collected from student-created photographs, student written responses, interviews of students, interviews of photography teachers, and the researcher's field notes. Major themes were discovered over time by applying a grounded theory approach to understanding the data. The curriculum brought a new level of student engagement, both in participation in the course and in the complexity of their image making. By incorporating the chosen topics, students' images were rich with personal meaning. Students retained concepts of historical and social uses for photography and demonstrated a base understanding of semiotic theory. Furthermore, the data points to a stronger sense of community and teacher-student relationships within the classroom. The researcher argues that this deeper rapport is due to the concentration on personal themes within the practice of photography. Setbacks within the study included censorship by the school of mature subjects, a limited amount of equipment, and a limited amount of time with the students. This study demonstrates the need for art curriculum to provide connections between visual art, interdisciplinary associations, students' level of development, and students' personal interests. The research provides a possible approach to redesigning curriculum for photography courses for the twenty-first century student.

Epilepsy is a chronic illness impacting the lives of over 300,000 children nationally. Sexson and Madan-Swain offer a theory that addresses successful school reentry in children that are chronically ill. Their theory posits that successful school reentry is influenced by school personnel with appropriate attitudes, training experiences, and by factors relating to the child's illness. The parents of 74 students, between second and twelfth grades, completed a questionnaire addressing their child's epilepsy and their current level of seizure control. Each child's homeroom teacher also completed a survey regarding their training experiences about epilepsy and their attitudes towards individuals with epilepsy. Additional information was gathered from the child's school regarding attendance rates, most recent Terra Nova test scores (a group achievement test), and special education enrollment status. Data were analyzed via four multiple regression analyses and one logistic regression analysis. It was found that seizure control was a significant predictor for attendance, academic achievement (i.e., mathematics, writing, and reading), and special education enrollment. Additionally, teachers' attitudes towards epilepsy were a significant predictor of academic achievement (writing and reading) and special education enrollment. Teacher training experience was not a significant predictor in any of the analyses.

While there are many elements to consider when determining one's risk of heat or cold stress, acclimation could prove to be an important factor to consider. Individuals who are participating in more strenuous activities, while being at a lower risk, will still feel the impacts of acclimation to an extreme climate. To evaluate acclimation in strenuous conditions, I collected finishing times from six different marathon races: the New York City Marathon (New York City, New York), Equinox Marathon (Fairbanks, Alaska), California International Marathon (Sacramento, California), LIVESTRONG Austin Marathon (Austin, Texas), Cincinnati Flying Pig Marathon (Cincinnati, Ohio), and the Ocala Marathon (Ocala, Florida). Additionally, I collected meteorological variables for each race day and the five days leading up to the race (baseline). I tested these values against the finishing times for the local runners, those from the race state, and visitors, those from other locations. Effects of local acclimation could be evaluated by comparing finishing times of local runners to the change between the race day and baseline weather conditions. Locals experienced a significant impact on finishing times for large changes between race day and the baseline conditions for humidity variables, dew point temperature, vapor pressure, relative humidity, and temperature based variables such as the heat index, temperature and the saturation vapor pressure. Wind speed and pressure values also marked a change in performance, however; pressure was determined to be a larger psychological factor than acclimation factor. The locals also demonstrated an acclimation effect as performance improved when conditions were similar on race day to baseline conditions for the three larger races. Humidity variables had the largest impact on runners when those values increased from training and acclimation values; however increased wind speed appeared to offset increased humidity values. These findings support previous acclimation research stating warm wet conditions are more difficult to acclimate to than warm dry conditions. This research while primarily pertaining to those participating physically demanding activities may also be applied to other large scale events such as festivals, fairs, or concerts.

Sacred apocalyptic texts claim to foretell coming events, warning the faithful of some terrible fate that lies beyond the present. Such texts often derive their power from successfully recasting past events in such a way as they appear to be "predicted" by the text and thus take on additional meanings beyond the superficial. This ex eventu status allows apocalyptic texts to increase the credibility of their future predictions and connect emotionally with the reader by playing on present fears. The fifth-century Daoist apocalyptic text, the Scripture on the Cycles of Heaven and Earth (Tiandi yundu jing, 天地運度經), is no exception. This thesis examines the apocalyptic markers in the poetic sections of the text, attempting to develop a strategy for separating the generic imagery (both to Chinese texts and the apocalyptic literary genre as a whole) from the more significant recoverable references to contemporary events such as the fall of the Jin dynasty and the subsequent founding of the Liu-Song dynasty.
